1. Scope
For buyers purchasing as consumers, Law No. 6502 on the Protection of Consumers and the Mesafeli Sözleşmeler Yönetmeliği (Regulation on Distance Contracts) apply. Consumer status is determined by the purpose of the purchase; requesting a corporate invoice does not in itself remove it. Section 8 applies to buyers acting for commercial or professional purposes.
2. Order Cancellation
You may send a cancellation request to [email protected]. It is assessed according to the stage the order has reached:
- Before payment: The order is cancelled free of charge; no amount is charged.
- After payment, before production or dispatch: The order is cancelled free of charge; the amount is refunded to your payment instrument within fourteen days of the cancellation being confirmed.
- For parts cut to your drawing and custom-manufactured products, once cutting or production has started: Because the goods are made to your specification, the order cannot be cancelled unilaterally. If the request is accepted, the raw material, preparation and labour costs incurred up to that point are deducted from the refund, the amount being notified to you before the cancellation is confirmed.
- After dispatch: The order cannot be cancelled; the provisions on the right of withdrawal (Section 3) and on defective products (Section 7) apply.
3. Right of Withdrawal
For standard products you buy as a consumer (plates sold from stock, the sample kit and arm sets), you may withdraw from the contract within fourteen days from the date on which the product is delivered to you or to the person shown at your address, without giving any reason and without paying any penalty. For orders delivered in several parts, the period begins on the day you receive the last part.
Please send your notice of withdrawal before the period expires, by email to [email protected] or in writing to Yenibosna Merkez Mah. Yalçın Koreş Cad. Kor Sok. No:9, Bahçelievler / İstanbul / Türkiye. It is sufficient to state your name, order number, order date and intention to withdraw, for example: “I exercise my right of withdrawal in respect of my order no. … dated ….” Receipt of your notice is confirmed by email. Since the burden of proving that you gave notice in time lies with you, you are advised to use a channel that can be documented.
4. Products Without a Right of Withdrawal
There is no right of withdrawal for products cut, machined or manufactured to your drawing, your design or the dimensions, tolerances or surface treatment you specify (Regulation on Distance Contracts, Art. 15(1)(b)). This covers cutting items ordered through the Site by uploading a DXF file and profiles and composite structures manufactured upon quotation; for cutting items you accept this by a separate confirmation box on the order page. The right of withdrawal for the other products in the same order is reserved.
Plates that have been cut, drilled, bonded or painted after delivery may also be returned under the right of withdrawal; however, the buyer is liable for any loss in value resulting from such processing.
5. Return Process and Shipping
Carrier designated for returns from delivery addresses in Türkiye: Yurtiçi Kargo. Upon your notice of withdrawal you are notified of the return consignment code. For returns from delivery addresses outside Türkiye no carrier is designated in advance; it is notified to you by email upon your notice of withdrawal.
Return shipping costs are borne by the seller. If the carrier has no branch at your location, the product is collected from you without additional cost.
Please send the product within fourteen days of your notice of withdrawal, with its invoice and any standard accessories, packed so that it is not damaged in transit. Examining the product in accordance with its ordinary operation, technical characteristics and instructions for use does not affect your right of return; our right to claim compensation for any loss in value caused by use beyond that scope is reserved.
6. Refunds
All payments collected, including delivery costs, are refunded within fourteen days from the date on which the product is handed over to the carrier designated for returns. If you send the product with another carrier, the period begins on the date the product reaches us; if you withdraw before the product is delivered to you, on the date your notice reaches us.
The refund is made in a single instalment, in a manner consistent with your payment instrument and without any cost to you. For card payments the refund is passed to the card issuer through PayTR; the time taken for the amount to appear on your card statement depends on the bank.
Refunds of card payments are made through PayTR to the card used for the payment; the time for the amount to appear on the card account depends on the bank. Refunds of bank transfer payments are made to the account from which the payment was made.
Consumer buyers complete and sign the return section on the printout of the e-Archive invoice sent with the product and return it with the product; corporate buyers required to issue invoices issue a return invoice.
7. Defective, Damaged or Incomplete Products
The seller is liable for loss of and damage to the product until it is delivered to you. Please notify a defective, damaged or incomplete product to [email protected] with photographs; notice within three business days of delivery is recommended so that the matter can be handled swiftly, and does not limit your statutory rights.
If the defect is confirmed, you may choose free repair, replacement with a non-defective equivalent, a price reduction or rescission of the contract; all shipping, return and replacement costs are borne by us. For parts cut to your drawing, if a cut departing from the drawing or the notified tolerance, or a material defect, is found, the part is recut free of charge or its price is refunded; your statutory remedies are reserved. Errors of dimension or geometry in the drawing, and differences in dimension, surface or colour within the tolerance range, are not deemed defects.
8. Business Buyers
The right of withdrawal does not apply to buyers acting for commercial or professional purposes; return and exchange requests are subject to our written approval. Such buyers inspect the product without delay on delivery; if apparent defects are not notified in writing within two business days of delivery, or latent defects within eight days of their discovery, the product is deemed accepted (Turkish Commercial Code No. 6102, Art. 23).
